AtomLabs - Privacy Policy

Introducing Atom, a multi-purpose Discord bot designed to enhance your experience on Discord with a variety of fresh features. This Privacy Policy outlines how we collect, use, store, and protect your personal information when you interact with Atom. By using Atom or Atom Developer, you consent to the data practices described in this policy. If you do not agree with this policy, please do not use Atom or Atom Developer.

2. Information We Collect

2.1. Data Collected

When using Atom or AtomAI, we may collect and process the following types of information:
• Discord userIDs
• Discord serverIDs
• Messages and prompts sent to AtomAI
• Contextual data to enhance user experience
• Metadata

2.2. Contextual Data

AtomAI features involve saving context and prompts from your interactions to provide more accurate and personalized responses. This data is retained to enhance ongoing sessions and future interactions.

2.3. Third-Party Data Processing

To deliver our AI-powered responses, AtomAI integrates with Google Gemini, an AI model from Google. This involves sharing your messages, prompts, and contextual data with Google for processing, and if AtomAI searches the web, your query may also be sent to Brave for returning results too. If you use our image generation tools, parts of that data will also be sent to Cloudflare to deliver such results.

3. How We Use Your Information

We use the information we collect for the following purposes:
• Service Provision: To deliver and improve Atom’s features, including our AI-powered responses.
• Personalization: To enhance your experience with AtomAI by providing context-aware responses.
• Security: To maintain the security of Atom and prevent misuse.
• Support: To respond to user inquiries and provide assistance.

4. Data Sharing and Disclosure

4.1. Gemini Integration

Atom uses Google Gemini to process AI requests, and uses Brave to search the web. Data shared with these companies is used solely for generating responses and enhancing AI functionality. Google, and Brave adhere to strict privacy practices to protect your data.

4.2. Legal Compliance

We may disclose your information if required by law, or in response to valid requests by public authorities, such as a court or government agency.

4.3. Business Transfers

In the event of a merger, acquisition, or sale of our assets, your information may be transferred to the new owners as part of the transaction.

5. Data Storage and Security

5.1. Data Storage

Your data is securely stored on servers that comply with industry standards for data protection. We employ reasonable measures to safeguard your information from unauthorized access, alteration, or destruction.

5.2. Data Retention

We retain your data only for as long as necessary to provide Atom’s services or as required by law. You may request deletion of your data at any time by opening a ticket at Atom Support, our Discord server.

5.3. Security Measures

We implement technical, administrative, and physical safeguards to protect your data. However, please note that no method of transmission over the Internet or electronic storage is entirely secure.

6. Children’s Privacy

Atom is not intended for users under the age of 13, and is against our Terms of Service (ToS). We do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected such information, we will take immediate steps to delete it. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us by opening a support ticket in Atom Support, our Discord server, to request its deletion.

7. User Rights

7.1. Access and Correction

You have the right to access and correct any personal information we hold about you. To do so, please open a support ticket in Atom Support, our Discord server.

7.2. Deletion

You may request the deletion of your personal data at any time. Please note that requesting deletion may limit your ability to use certain features of Atom.

7.3. Opt-Out

If you wish to opt-out of data collection and sharing, you can stop using Atom and request the deletion of your data. However, doing so may limit your access to Atom’s features.

8. Amendments

We may update this Privacy Policy from time to time. Any changes will be posted on our annoucements channel in Atom Support, and the "Effective Date" at the top of this policy will be updated. Continued use of Atom after changes are posted constitutes your acceptance of the revised Privacy Policy.

9. Governing Law

This Privacy Policy is governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

1. Introduction

Introducing Atom, a multi-purpose Discord bot designed to enhance your experience on Discord with a variety of fresh features. By using Atom or Atom Developer, you agree to comply with our Terms of Service ("Terms"). If you do not agree to these Terms, please do not use Atom or Atom Developer.

2. Eligibility

You must be at least 13 years old to use Atom. By using Atom, you represent and warrant that you meet this eligibility requirement.

3. Description of Features

Atom offers a variety of features to help manage your Discord server, including but not limited to:
• Moderation tools: Automate server management tasks.
• AI-powered responses: Provide users with intelligent, context-aware responses.
• Contextual Memory: Saves the context and prompts from your interactions to improve the accuracy and relevance of AI-generated responses.
• Third-party API Integration: Requests and data from AtomAI are sent to Google, and optionally Brave for processing. (see more below)

4. Data Collection and Privacy

4.1. Data Collected

To enable Atom’s features, including our AI-powered responses, the following data may be collected:
• Discord userIDs
• Discord serverIDs
• Messages and prompts sent to AtomAI
• Contextual data to enhance user experience
• Metadata related to bot interactions
This data is used solely to provide and improve Atom’s features and is stored securely. Parts of your data may be shared with Google Gemini, an AI model from Google, solely for the purpose of processing AI requests and generating responses. If you use our image generation tools, parts of your data will also be sent to Cloudflare, for the purpose of processing such requests and generating content based from that.

4.2. Data Usage

Data collected by Atom is used to:
• Provide accurate and context-aware responses for AtomAI
• Improve the functionality and user experience of the bot
• Analyze bot usage and performance

4.3. Data Sharing

AtomAI integrates with Google Gemini, Brave Search, and Cloudflare to provide said AI-powered features. Parts of your data, including prompts, will be sent to these companies for processing, depending on what functionality is used as part of your request. These companies are obligated to protect your data and comply with privacy regulations, and you may want to view their data protection measures for more information on the matter.

4.4. Data Retention

Your data will be retained for as long as necessary to provide Atom’s services or as required by law. You may request the deletion of your data at any time by opening a ticket at Atom Support, our Discord server.

5. Acceptable Use

You agree to use Atom and AtomAI only for lawful purposes and in accordance with these Terms. You agree not to:
• Use Atom in any manner that could disable, overburden, damage, or impair the bot or interfere with any other party’s use of the bot
• Use AtomAI to generate inappropriate, illegal, unlawful responses, or imagery that could cause harm
• Engage in any activity that is harmful, illegal, abusive, or violates Discord’s Community Guidelines
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Atom, the server on which Atom is hosted, or any associated databases

6. Limitations of Liability

Atom is provided on an "as-is" basis, without warranties of any kind, either express or implied. We do not guarantee that Atom will be error-free, secure, or continuously available. To the fullest extent permitted by law, we disclaim all liability for any damages or losses resulting from your use of Atom.

7. Termination of Service

7.1. User/Server Termination

We reserve the right to terminate or suspend you, or your server's access to Atom, without prior notice, if you violate these Terms or misuse the bot.

7.2. Service Termination

We reserve the right to discontinue Atom at any time, without prior notice. We will make reasonable efforts to notify users of any such termination.

8. Amendments

We may update these Terms from time to time. Changes will be posted on our annoucements channel in Atom Support, and the "Effective Date" at the top of this policy will be updated. Continued use of Atom after changes are posted constitutes your acceptance of the updated Terms.
